This Privacy Policy is effective as of June 14th, 2023, and describes the policies and procedures of The New Door EL (“The New Door EL”) and, unless otherwise indicated, its affiliates and subsidiaries collectively referred to as “The New Door EL,” “the “Company,” “we,” “our,” “us”). It applies to the collection, use, and disclosure of your information on https://thenewdoor.co.in/, or any website that The New Door EL may develop in the future (collectively, the “Websites”); any and all The New Door EL Applications available through any platforms or marketplace (the “The New Door EL Apps,” and together with the Websites, the “Online Resources”); and the services, features, or content we offer through the Online Resources or otherwise (collectively, the “Services”).

Some terms used in this Privacy Policy are defined in our Terms of Use; if undefined herein, the definition provided in the Terms of Use will govern.

When you use our Services, you are accepting the practices outlined in this Privacy Policy and our Terms of Use, and you hereby consent to the collection, transfer, aggregation, storage, disclosure, and other uses of your information as described in this Privacy Policy. Your continued use of the Services constitutes your acceptance of this Privacy Policy.

Information Collection, Use, and Opting Out

The type of information we collect depends on your level of engagement with the Online Resources. The more engaged you are with the Online Resources and the more features you utilize, the more information we may need to provide our Services.
All Thenewdoor Website and Application Users. We automatically receive and record information from both registered and unregistered users of the Online Resources (meaning both those who establish accounts and those who merely visit) whenever you interact with them. This includes IP address data from our server logs, cookie information, the pages you request, and the URL of the website that connected you to the Online Resources. From all users of the Thenewdoor website,
we may also collect the user resettable mobile device ID (such as the ID for Advertising on iOS and Android ID on Android) and your geolocation information so that we can interact with you to provide geo-specific information, such as homes for sale near you and information about listing your home for sale. Your IP address serves the same function for Website users. Users of Thenewdoor Apps can turn off our access to geolocation by adjusting “location services” within your mobile device settings. We may use the information listed above to help diagnose problems and performance issues, analyze trends, customize your experience and administer the Online Resources.

Cookies and similar technologies

When you use the Services and/or visit the Online Resources, we may use cookies and similar technologies like pixels, web beacons, and local storage to collect information about how you use the Online Resources and related Services and provide features to you.

Thenewdoor Cookies. We may put Thenewdoor cookies on your computer (including your mobile device) to enable our servers to recognize your web browser and tell us how and when you visit the Online Resources and otherwise use the Services, including recent searches using the Online Resources. A “cookie” is a small electronic file containing a string of characters that is sent to your computer when you visit a website. When you visit the website again, the cookie allows that site to recognize your computer. Cookies may store user preferences and other information. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. While you are free to disable cookies on your browser, we recommend that you leave cookies activated to use some of the most useful Thenewdoor features.

Third-Party Cookies. for Website Use Analysis & Targeted Ads on Other Websites. We use third parties such as Google, or similar companies, to help us analyze how people are using the Websites. We also use the Google Analytics Advertising service to provide us with demographic data about our users on an anonymous basis, and this Google service uses a cookie that can be recognized by Google or its affiliates when you visit other websites. These third parties are authorized to use cookies and other tracking technologies to access personal information of visitors to the Websites. Access to and use of personal information by such third parties is governed by the third parties’ privacy policies. To see Google’s privacy policy, click here. Such third parties may serve Thenewdoor ads to you on other websites on our behalf. Similarly, the Websites place cookies on your browser that are read when you visit Facebook, so that during your visits to the Facebook website you might receive Thenewdoor advertising based on the pages you visited on the Website(s). We may work with other companies and use their cookies to target Thenewdoor ads to you on other websites.

Log Files. Log file information is automatically reported by your browser each time you make a request to access (i.e., visit) a web page or app. It can also be provided when the content of the webpage or app is downloaded to your browser or device. When you use our Services, our servers automatically record certain log file information, including your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Services, domain names, landing pages, pages viewed, and other such information. We may also collect similar information from emails sent to our users which then help us track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Services.

Opting out of Targeted Advertising. If you do not wish to have us collect, use, and share information about you to deliver targeted online advertising in this manner, please review the instructions to opt out of targeted advertising on the website where you saw our advertisement. Please note that most opt-out mechanisms are cookie-based and will only affect the specific computer (including mobile device) and browser that is used to submit an opt-out request. If you have multiple computers or change computers, or use multiple browsers, you will need to submit opt-out requests for each such computer or browser. In addition, if you delete, block, or otherwise restrict cookies, you will need to review your opt-out choices to ensure that any opt-out cookies remain effective.

Opting Out of Mobile Device ID Tracking. Mobile device users may reset the identifier or opt-out of receiving interest-based ads in their mobile apps. Android users and Apple iOS users should follow the directions provided by those companies to stop mobile ad tracking.

Opting out Generally. The Digital Advertising Alliance provides customers with the ability to opt-out of having their online behavior recorded and used for advertising purposes. To opt-out of having your online behavior collected for advertising purposes (ex: Thenewdoor ads to you on Facebook), please follow the opt-out instructions provided on the website where you saw the advertisement. Choices you make are both browser and device specific. This means that, for example, if you opt out when using Safari on your phone, you will not be opted out on Firefox or on your laptop.

Some browsers may have the option to transmit a “do not track” signal to websites. The Websites do not respond differently or limit their practices under the terms of this Privacy Policy when you visit a Website with a browser that uses a “do not track” signal or similar mechanism.
Registered Thenewdoor Website Users
When providing real estate brokerage Services, we are required to obtain your name and email address as a condition of our licenses with the multiple services in order to allow you to access the full MLS listings. You give us this information when you create your Thenewdoor account. When you give us this information at one of our events, or upon request, we will create a Thenewdoor account for you, and this Privacy Policy and our Terms of Use will apply. In addition, when you are signed in to your Thenewdoor account and using Thenewdoor through Facebook, Twitter, or any other third-party authorization service, we may make use of the data that they provide us to further customize your Thenewdoor experience.

Account Password Security. Your Thenewdoor account password is encrypted on our server and is known only to you. It is critical that you keep this password secure and do not share it with any other individuals. Thenewdoor will not be responsible for any lost, compromised, or destroyed data as a result of a lost, stolen, or voluntarily distributed password.

Account Updates. If you would like to correct, amend, add, or delete personal information associated with your account, please contact us as described below in the “Contact Us” section of this Privacy Policy. However, even after you update information, we may maintain a copy of the original information in our records.

Home Tours

When you submit a home tour request, we will ask for your tour date and time preferences, as well as your phone number. We will also ask some questions so that our agent can verify your identity. When you meet with one of our agents at the home, the agent will ask you to verify your identity, and will ask for a photo ID.

Thenewdoor Clients

When you start utilizing the Services provided by Thenewdoor and begin working with our coordinators and agents, you become a Thenewdoor client. As part of the home purchase or sale process, you will need to provide such requested information as is customary for a mortgage application, home purchase, or sale transaction. This information can include, without limitation, your name, address, phone number, email address, buyer loan pre-approval documentation, and seller property information. We ask you, as a buyer, for loan pre-approvals from a mortgage broker or lender to determine which homes are in your price range, and to help you make an offer more quickly when you do find a home. If you are a seller, you are legally required to disclose certain information about your property to prospective buyers and/or to Thenewdoor. Once you sign a Buyer Agreement with us, your relationship with Thenewdoor is governed by that agreement, as well as our online Terms of Use and this Privacy Policy.

Information Storage

Thenewdoor takes generally accepted administrative, physical, and electronic measures designed to protect the information that we collect from or about you from unauthorized access, use, or disclosure. However, since no method of transmitting information over the Internet or storing information is completely secure, Thenewdoor cannot ensure the security of any information you transmit to Thenewdoor or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed.

Information Sharing

We may share your information with Thenewdoor personnel as legally allowed and in the normal course of business, and with Thenewdoor’ entity affiliates. We may also share some of your information with third parties as discussed below.

Third Parties. Thenewdoor may share your information with other companies for the purpose of marketing Thenewdoor’ Services that may be of interest to you, or to promote and support our Online Resources. To accomplish this, we may combine the information that you give us and information about your usage of the Services with other personally identifiable information (i.e., demographics or past purchase history) available from our records and other sources. Per agreements with 3rd party marketing partners, they are not allowed to use your information for any purpose other than supporting and promoting our Services. Such 3rd party privacy policies (found on the 3rd parties’ websites) govern the collection and use of information you provide on their websites.

Change of Control. If we sell or otherwise transfer part or the whole of Thenewdoor or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information such as name and email address, user content and any other information collected through the Services may be among the items sold or transferred. By using the Online Resources, you consent to the transfer of your data if such an event were to occur. The buyer or transferee will be required to honor the commitments we have made in this Privacy Policy.

Legal Requests. We may access, preserve, and share your information in response to a legal request (like a search warrant, court order, or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to detect, prevent and address fraud and other illegal activity; to protect ourselves, you, and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed, and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigation concerning possible violations of our terms or policies, or otherwise to prevent harm. Thenewdoor disclaims any liability related to the lawful or believed to be lawful response to requests for your information.

Thenewdoor Clients: Public Record Information. Please be aware that home sales and purchases are a matter of public record, and your name and address, the price you paid, your property taxes, and other information will be available from public sites regardless of the brokerage(s), if any, who assist in the transaction. We may post some information that typically becomes part of the public record of a home sale or purchase.

Non-Public Record Information. We share information obtained from you that is not public record in order to facilitate your home purchase or sale transaction.

Service Providers to all Thenewdoor Clients. Our agents work with third parties to process your home search and sale transaction and must share your information with those third parties. Examples include MLSs and providers of software used for document preparation and electronic signing.

Home Seller Service Providers. As is customary for a home sales agent, we may share your listing information with listing websites, such as Zillow.com or Trulia.com. We may also share your listing information with listing vendors such as photographers, home staging experts, and inspection or repair professionals.

Home Buyer Service Providers. As is customary for a home purchase agent, we may must share your buying information with inspectors, title companies, escrow agents, closing attorneys, lenders, and other third parties as needed to process your transaction.

Potential Buyers. Potential Buyers. By law, we are required to disclose to potential buyers certain information you provide about your property.

Negotiations. We may also post on our Online Resources price offers and counteroffers. We do not post your name on our Online Resources without your permission. If the sale is closed, the price and the fact that you bought or sold your house and the purchase price will become a matter of public record.

Email & Text Message Communications

We communicate with account holders and clients about their accounts and home tours, searches, and sales by email and/or text messages. Standard text messaging rates apply and are the responsibility of the client or account holder. You may also subscribe to Listing Alert Emails with customized summaries of homes for sale. If you opt-in to also receive marketing email and/or text messages, Thenewdoor may send you news, surveys, or promotions. If you do not want to receive alerts, text messages, or marketing emails from us, please visit the Preferences section of your Account Settings, and/or follow the unsubscribe instructions contained in the email message.

Changes to this Privacy Policy

Please check this page periodically for changes. Your continued use of the Services following the posting of changes to this policy will mean you accept those changes. If we make any changes to this Privacy Policy, we will post the updated Privacy Policy here. Please check our Websites regularly to review updates to this Privacy Policy.

Children

The Online Resources are meant for adults only. We do not market to or allow individuals under the age of 18 to create an account, and we do not knowingly collect personally identifiable information from children under the age of 13. If you are a parent or legal guardian and think your child under 13 has given us information, please email us at the email address below or write to us at the address listed at the end of this policy; please mark your inquiries “COPPA Information Request.” If we become aware that a child under 13 has provided us with personal information without parental consent, we will take steps to remove such information and terminate the child’s account.
